The down-payment (30% of the total costs) is nonrefundable.
For cancellations 180 days – 91 days before the trip date, a 50% cancellation fee will be deducted of all payments made after the down payment.
For cancellations made 90 days or less prior to departure no refund can be granted.
Any refunds outside of our terms will be subject to a claim on your trip insurance company. We will create a proof letter for your insurer over your loss, Mischief Voyage and its subsidiaries can not be held accountable if your insurance rejects your claims for any reason and Mischief Voyage and its subsidiaries are not responsible for any charges, fees, or exchange rate losses in any cancelation or refund event.
Mischief Voyage reserves the right to cancel a trip if the customer gives a justifiable reason to do so eg. the Customer lies about their personal data, damages the boat, does not obey the rules on board, endangers the boat or the guests, marine live or third parties, etc). In such rare instances, Mischief Voyage will not grant any refund.
Mischief Voyage and its subsidiaries are not to be held accountable for failure to perform their obligations if such failure is as a result of acts of god (including fire, flood, earthquake, storm, hurricane, volcanic ash cloud, or another natural disaster), war, invasion, the act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute or strike.
For illness during a trip, no refund will be granted. On your request, we will issue a letter for your trip insurance.
The above cancelation policy applies. We strongly recommend trip insurance to cover such events.
Mischief Voyage and its subsidiaries can not be held accountable in any way for any weather or situation caused by weather. Mischief Voyage can not be held accountable for decisions from authorities regarding weather. Weather is not a valid reason for cancelation.
Mischief Voyage and its subsidiaries reserve the right to rearrange, cancel or substitute elements of any itinerary without notice based on weather conditions.
The safety and well-being of our customers is our upmost concern. We expect our guests to follow the instructions of out partners at al times. Especially during activities like diving.
Mischief Voyage and its subsidiaries are not to be held accountable for any losses, damage, death, injuries, or claims whatsoever arising from, connected or related to any activities engaged in by guests during a trip. This includes all shore excursions and transfers. Guests engage in all activities aboard or off the boat at their own risk.
Mischief Voyage and its subsidiaries are not to be held accountable for any delays or interruptions caused by flight delays, cancellations or any other travel arrange made by or external or in conjunction to your booked trip.
Mischief Voyage and its subsidiaries are not to be held accountable for failure of the customer to submit the requested personal data, passports etc.
Once a reservation is made by any means of communication,Mischief Voyage through here subsidiaries issues an invoice over the full amount and the invoice for the 30% down-payment the downpayment has to be payed within 7 days. With the payment of the invoice or the down-payment the reservation becomes valid and all terms and conditions are accepted on the side of the customer. Payment details as set out on your invoice.
Payment of the balance must be made to MischiefVoyages latest 90 days prior to the date of departure. If full payment of the balance is not received by this date then MischiefVoyages can cancel the booking and enforce the cancellation policy.
Short notice Bookings:
Full payment must be made to Mischief Voyages at the time of booking if the reservation is made less than 90 days prior to the date of departure.
MischiefVoyages and its subsidiaries reserve the right to make alterations and changes to brochure information, service descriptions and prices in the brochures or online and price lists at any time.
In rare circumstances it is possible that prices must be increased. The circumstances under which this may occur are as follows: – high increases in transportation costs (including fuel costs)- high increases in state taxes and duties (i. E. Airport taxes, landing fees, embarkation/disembarkation fees, sales taxes, etc. )- high currency fluctuations etc.

Preamble
These Terms and Conditions (“T&C”) govern all bookings and services provided by Samara Yachting and its subsidiaries or partners (the “Principal”) for yacht charters. These terms are binding for all clients who engage in these services, either directly or through an authorized Travel Agency (“Agency”).
1. Cruise Type
Samara Yachting offers two charter models:
1.1. Private Charter: The entire vessel is chartered exclusively by one group. Guests enjoy full use of all cabins, crew, and a custom itinerary. Activities include island hopping, snorkeling, and leisure cruising.
1.2. Open Trip (FIT): Guests book individual cabins for 2 guests (extra beds available) and share the vessel and program with other travelers on a fixed schedule.
2. Check-In and Check-Out Times
Samara Yachting offers two charter models:
2.1. Check In: Boarding begins at 10:00 AM on the first day of the trip.Guests are strongly encouraged to arrive at the destination one day in advance to avoid delays.
2.2. Checkout: Disembarkation is scheduled around 2:00 PM on the final day of the cruise.
2.3. For Private Charters, check-in and check-out times may vary depending on the customized itinerary and flight schedules, as agreed upon in advance with the Principal.
3. Bookings and Payments
Charters and FIT below USD 5000.- per night:
3.1. Deposit: A non-refundable deposit of 30% is required within 3 days of booking to confirm a reservation.
3.2. Balance Payment: The remaining 70% must be paid at least 30 days before the departure date.
3.3. Short Notice Bookings: For bookings made within 30 days of departure, full payment is required at the time of booking.
Charters and FIT below USD 5000.- per night:

3.7. Failure to Pay: If payment deadlines are not met, the booking may be canceled without refund of previous payments.
3.8. Payment Method: Payment may be made by bank transfer or credit card. Credit card payments incur a 3% processing fee. All bank charges are the responsibility of the guest or agent.
3.9. Payment Instructions: All payments must be made to the official bank account in the currency specified in the invoice issued by the Principal.
4. Cancellations and Refunds
Charters and FIT below USD 5000.- per night:
4.1. More than 30 days before departure: Payments are refundable minus the 30% deposit.
4.2. 30 days or less before departure: No refund.

General Policies
4.5. General Refund Policies: Payments are generally non-refundable. However, Samara Yachting will make every effort to assist with rescheduling or finding fair solutions when possible.
4.6. Force Majeur: In case of natural disasters, port closures, government restrictions, or similar uncontrollable events, Samara Yachting may offer rescheduling or alternative solutions at its sole discretion. Rain or cloudy weather is not considered valid grounds for cancellation or refund.
5. Rescheduling
We Understand Life Happens: While our policies are firm to ensure fairness and operational consistency, Samara Yachting may, at its sole discretion, choose to offer alternative solutions in extraordinary cases. Any exception granted is made without obligation and does not set a precedent.
6. Illness Before or During Our Trip
Prior to Trip: The cancellation policy remains in effect. No refunds are granted unless covered by travel insurance.
During Trip: If a guest falls ill and cannot participate in activities, no refund will be granted. A formal letter may be issued to support a travel insurance claim.
7. General Inclusions and Exclusions

8. Guest Responsibilities
8.1. Guests must follow all safety instructions provided by the crew
8.2. Respectful and cooperative behavior toward staff and fellow guests is expected at all times.
8.3. Guests are financially responsible for any damage to the vessel or its equipment caused by negligence or misconduct.
8.4. Failure to comply with safety or ecological rules may result in exclusion from activities without refund.
9. Onboard Payments
9.1. Onboard purchases, such as alcoholic drinks or merchandise, can be paid in cash or by credit card (3% surcharge).
10. Diving Activities (if offered)
10.1. Guests must hold a valid dive certification (e.g., PADI Open Water)
10.2. Dive insurance is mandatory and must be presented before the first dive.
10.3. A signed liability waiver is required before participating.
10.4. Missed dives for personal or medical reasons are non-refundable.
11. Liability and Indemnity
11.1. Guests participate in all onboard and offboard activities at their own risk. Samara Yachting takes all reasonable precautions to ensure guest safety; however, the nature of sea travel and adventure activities involves inherent risks.
11.2. Samara Yachting, its subsidiaries, partners, employees, and crew shall not be held liable for any injury, illness, death, damage, loss, delay, or expense arising from (but not limited to):
11.2.1. Accidents such as slips, trips, or falls onboard (including staircases, decks, or wet areas).
11.2.2. Participation in snorkeling, diving, swimming, trekking, or other activities.
11.2.3. Participation in snorkeling, diving, swimming, trekking, or other activities.
11.2.4. Guest negligence, disregard of safety instructions, or inappropriate behavior.
11.2.5. Loss, theft, or damage to personal belongings.
11.2.6. Delays, missed flights, or travel disruptions not directly caused by the Principal.
11.2.7. Incomplete or inaccurate travel documentation or insurance coverage.
11.3. The Principal shall only be liable where gross negligence or intentional misconduct by the crew or company representatives can be clearly demonstrated. General sea conditions, weather-related movement, or incidental onboard hazards do not constitute grounds for liability
11.4. Guests are strongly advised to obtain comprehensive travel and medical insurance, including coverage for accidents, evacuation, missed connections, and activity-related injuries (such as diving or trekking).
11.5. By participating in the cruise, guests agree to fully indemnify, defend, and hold harmless Samara Yachting, its affiliates, and representatives from any claims, damages, losses, or expenses (including legal fees) arising from their actions or omissions during the trip. This indemnity shall survive the end of the voyage and apply to any post-trip claims. Weather and Itinerary Changes.
11.6. Weather conditions at sea are unpredictable. Rain, swell, or cloudiness may occur and are not grounds for refund or cancellation.
11.7. Samara Yachting will follow all directives from port authorities or the Indonesian Coast Guard. If these result in itinerary changes or cancellations, no compensation will be offered.
11.8. The crew may adjust the route, activities, or schedule at their discretion to ensure safety and optimize guest experience.
12. Changes and Price Adjustments
12.1. Samara Yachting reserves the right to update brochures, service descriptions, and pricing at any time before a booking is confirmed.
12.2. In very rare cases, price adjustments after booking may occur due to:
12.2.1. Accidents such as slips, trips, or falls onboard (including staircases, decks, or wet areas).
11.2.2. New government fees, taxes, or port charges.
11.2.3. Major exchange rate fluctuations.
11.2.4. Guests will be informed of such changes and may choose to accept or cancel under applicable terms.
13. Cancellation by the Principal for Guest Misconduct
13.1. Samara Yachting reserves the right to cancel a guest’s participation without refund if the guest:
13.1.1.Provides false personal information.
13.1.2. Fails to follow crew instructions or safety procedures.
13.1.3.Damages the vessel.
13.1.4.Endangers themselves, other guests, or marine life.
14. Governing Law
14.1. These Terms & Conditions are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through mediation or arbitration in Bali.
